Today, June 26, 2015, the United States Supreme Court announced a landmark decision, in Obergefell v. Hodges and three related cases that the Constitution guarantees a right to same-sex marriage. The Court declared that, because of the Fourteenth Amendment, every state must recognize same-sex marriages legally performed in other states. Taking an even greater step than many people expected, the Court also decided that every state must issue marriage licenses to same-sex couples wishing to marry--effectively striking down every same-sex marriage ban in every state.
In the majority decision, Justice Kennedy writes, “The nature of injustice is that we may not always see it in our own times. The generations that wrote and ratified the Bill of Rights and the Fourteenth Amendment did not presume to know the extent of freedom in all of its dimensions, and so they entrusted to future generations a charter protecting the right of all persons to enjoy liberty as we learn its meaning.”
